Terms of Service

Last updated: September 17, 2026

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and services provided at echod.ai and related domains (collectively, the “Service”), operated by Seven Spikes Ltd, a company registered in Bulgaria under company number 201117332, with registered address at 38 Cvetna Gradina Str., Bulgaria (“Echod”, “we”, “us”, or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and “you” refers to that entity.

1. The Service

Echod is an AI search visibility tracking platform. It helps you monitor and analyze how brands, products, and websites appear in responses generated by AI-powered search and assistant tools. The Service includes this marketing website, the Echod web application, associated APIs, and any related documentation.

We may modify, improve, or discontinue features of the Service at any time. We will make reasonable efforts to notify you of material changes that adversely affect paid functionality.

2. Eligibility and accounts

You must be at least 16 years old to use the Service, and at least 18 years old (or the age of majority in your jurisdiction) to purchase a paid subscription. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at sales@echod.ai if you suspect unauthorized use of your account.

You agree to provide accurate, current, and complete information when creating an account and to keep it up to date.

3. Free trial

New customers may be offered a 7-day free trial of a paid plan. At the end of the trial, your subscription begins and the applicable fee is charged unless you cancel before the trial ends. We reserve the right to modify or withdraw trial offers and to limit trials to one per customer.

4. Subscriptions, fees, and payment

The Service is offered on a subscription basis. Current plans and pricing are published on our pricing page (currently Starter at $79/month, Pro at $199/month, and Enterprise with custom pricing). Prices are subject to change; changes take effect at your next billing cycle after reasonable notice.

If you are a consumer in the European Union: by starting a paid subscription or trial you request immediate access to digital services and acknowledge that, once performance has begun with your consent, you may lose your statutory 14-day right of withdrawal to the extent the service has been supplied.

5. Acceptable use

You agree not to, and not to permit others to:

We may suspend or terminate access for violations of this section, with notice where practicable.

6. Your data and content

You retain all rights to the data, brand names, domains, keywords, and other content you submit to the Service (“Customer Data”). You grant us a limited, non-exclusive license to host, process, and display Customer Data solely to provide and improve the Service. You are responsible for having the necessary rights to the Customer Data you submit.

Our processing of personal data is described in our Privacy Policy.

7. Intellectual property

The Service, including its software, design, reports, aggregated metrics, and documentation, is owned by Seven Spikes Ltd or its licensors and is protected by intellectual property laws. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable right to access and use the Service for your internal business purposes during your subscription term. No other rights are granted.

8. Third-party services and AI outputs

The Service analyzes and reports on outputs of third-party AI systems and search engines. We do not control those systems, and their outputs change over time. Reports, scores, and visibility metrics provided by the Service are informational estimates and do not constitute professional advice. You are responsible for decisions made based on the Service.

9. Disclaimer of warranties

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, or that data (including AI visibility metrics) will be accurate or complete. Nothing in these Terms limits statutory rights that consumers have under applicable law.

10. Limitation of liability

To the maximum extent permitted by law: (a) neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data; and (b) our total aggregate liability arising out of or relating to the Service is limited to the amounts you paid to us in the 12 months preceding the event giving rise to the claim. These limitations do not apply to liability that cannot be limited under applicable law, including liability for intent or gross negligence, or for death or personal injury.

11. Indemnification

If you use the Service as a business, you will indemnify and hold us harmless from third-party claims arising from your Customer Data or your use of the Service in violation of these Terms or applicable law.

12. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you materially breach these Terms and (where the breach is curable) fail to cure it within a reasonable period after notice. Upon termination, your right to use the Service ends. We may delete Customer Data after a reasonable retention period following termination; you may request an export of your data before then. Sections that by their nature should survive (including Sections 7, 9, 10, 11, and 14) survive termination.

13. Changes to these Terms

We may update these Terms from time to time. For material changes we will provide reasonable advance notice (e.g., by email or in-app notice). Continued use of the Service after changes take effect constitutes acceptance. If you do not agree, you must stop using the Service and may cancel your subscription.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Bulgaria, without regard to its conflict-of-law rules. Disputes shall be subject to the exclusive jurisdiction of the competent courts of Bulgaria. If you are a consumer residing in the EU, you also benefit from mandatory provisions of the law of your country of residence and may bring proceedings in your local courts. The European Commission’s online dispute resolution platform is available at ec.europa.eu/consumers/odr.

15. General

These Terms, together with the Privacy Policy and any order form, constitute the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
